  • MAJA Sportswear, as a responsible and respectful company of personal data, makes this privacy notice available to you in order to guarantee the right of data subjects to informational self-determination, thus complying with the applicable provisions of the Federal Law on the Protection of Personal Data Held by Private Parties (hereinafter the "Law"), in order to inform you of the use that will be given to the information you provide, as well as the way in which you can limit the use of said data.

MAJA SPORTWEAR, SA DE CV (hereinafter "MAJA Sportswear"), with registered office at Blvd. Alfonso Zaragoza Maytorena 1980, Desarrollo Urbano Tres Ríos, in Culiacán, Sinaloa CP 80020, where applicable, will process the following Personal Data of visitors to our Website and/or the owner of our Services (hereinafter the "Owner"):

MAJA Sportswear is committed to maintaining constant and active communication with our data subjects. Unless otherwise notified or instructed by the Data Subject, the Data Subject consents to the processing of their Personal Data within and outside the United Mexican States in accordance with this Privacy Notice and understands that such data may be handled and/or transferred directly or indirectly by MAJA Sportswear, third-party service providers, and/or our business partners, as well as, where applicable, competent authorities within the applicable legal framework.

Authenticate the identity of the Holder.


Contact you by any means you have provided to MAJA Sportswear to follow up on quotes, orders, estimates, budgets, and service proposals.


Answer questions, comments, and queries about the products or services to be contracted with MAJA Sportswear.


Make available to the Owner the necessary documentation within the procedure carried out with MAJA Sportswear for due consultation, understanding and signature.


To evaluate and weigh the start of a relationship between MAJA Sportswear and the Owner from an accounting, administrative and commercial perspective.


SECONDARY PURPOSES FOR CUSTOMERS, SUPPLIERS AND PROSPECTED CUSTOMERS AND SUPPLIERS.


Contact the Owner for the purpose of notifying him/her of updates on products and services;


Evaluate the quality of MAJA Sportswear's service in relation to its business relationship;

Sending promotional and advertising information from MAJA Sportswear or its strategic partners, as well as information about new services or products, programs, events, courses or classes, events, and newsletters.


Use the Owner's information for statistical purposes.


PRIMARY PURPOSES FOR COLLABORATORS.

MECHANISMS FOR THE HOLDER TO EXPRESS HIS/HER REFUSAL TO THE PROCESSING OF HIS/HER PERSONAL DATA FOR SECONDARY PURPOSES.

In the body of the email, the Data Subject must specify the purposes for which they wish to express their refusal, as well as their identification details, so that their request can be fulfilled.

Suppliers - companies that request business references; risk rating, analysis, and credit granting companies; companies dedicated to portfolio recovery through judicial and extrajudicial means, when necessary; legal services companies for the processing of claims and/or complaints, when necessary; transactional email service providers; financial institutions for payment of services and products; among our branches and subsidiaries to provide you with better attention and service. Likewise, personal data may be transferred to government institutions and agencies for compliance with Mexican laws, as well as for the exceptions provided in Article 37 of THE LAW.


The recipients of personal data mentioned in the previous paragraph, in accordance with THE LAW, assume the same obligations and responsibilities as MAJA Sportwear for the correct processing of the personal data transferred to them.


If you are not satisfied with any of the transfers described here, please follow the procedure described within five days of the first contact we had with you, otherwise we will understand that you have given us your consent.


MEANS AND PROCEDURE FOR THE EXERCISE OF ARCO RIGHTS.

MAJA Sportswear recognizes the right of Data Subjects to exercise ARCO Rights over their Personal Data, which consist of the following:


  1. Right of Access: To know which of your Personal Data MAJA Sportswear holds and the purposes for which it is processed.
  2. Right to Rectification: Request the correction of your Personal Data if it is outdated, inaccurate, erroneous, or incomplete.
  3. Right to Erasure: Request to delete any record or copy of your Personal Data, whether physical or electronic.
  4. Right to Object: Request that your Personal Data be stopped from being used.

The exercise of the rights described in this section is carried out through:


  1. You must go to the address of MAJA Sportwear, to the Personal Data Protection department and fill out the form that will be provided to you, or
  2. By written request sent via email to info@majasportswear.com with the subject line "Exercise of ARCO Rights." The email address above corresponds to the department that will process the requests in question and may be contacted by Data Subjects at any time. In the message, the Data Subject must prepare the request in writing using a computer, typewriter, or handwritten. The request must include:

  4. A clear and precise description of the Personal Data for which you intend to exercise any of the ARCO Rights, as well as any documents that allow you to locate them.
  5. Mention the ARCO Law you wish to practice and your motivation for doing so.
  6. The arguments that support your position.
  7. If a data correction is requested, the changes to be made must be indicated and documentation proving the reason for the requested changes must be provided.
  8. Date from which you want the revocation to take effect.
  9. Official document proving your identity, which must be attached to the application.
  10. Sign it with your own handwriting using the same signature that appears on your official identification.
  11. Scan it and email it to info@majasportswear.com;


Likewise, the application must be accompanied by the following documents in PDF format:


  1. Official identification of the Holder or his representative.
  2. Document proving that the personal information is in the possession of MAJA Sportswear.
  3. If the Owner does not submit the application in person, the person who does must provide proof of representation. This can be done through a public deed or a power of attorney signed before two witnesses, along with official identification of the Owner and representative.

The Data Subject must take into account that, in order to have sufficient elements to respond to their request, MAJA Sportswear may request additional information within 5 (five) business days following receipt of the request. Following MAJA Sportswear's request, the Data Subject will have a period of 10 (ten) business days to process this request. In this case, the 20 (twenty) business day period mentioned in the previous paragraph will begin to run on the day following the day on which the Data Subject responds to MAJA Sportswear's request.


If the request is declared admissible and the Holder has proven his/her identity and ownership of the ARCO Right that he/she intended to exercise, Access to Personal Data, the requested changes, Cancellation or the response to the Opposition will be made within a maximum period of 15 (fifteen) business days counted from the date on which the request has been responded to.


In the case of requests for Access to Personal Data, they will be delivered upon verification of the identity of the applicant or representative, as appropriate. Such delivery will be made in simple copies to the address mentioned herein, or in electronic documents to the email address from which the request was sent.


In the event that the object of the request is the Opposition, the Processing of Personal Data will cease on the business day immediately following the date on which the affirmative response has been communicated to the Owner.


REASONS FOR DENYING ACCESS, RECTIFICATION, OPPOSITION AND CANCELLATION OF THE PERSONAL DATA PROVIDED BY YOU


MAJA Sportwear may deny you:


  1. Access to personal data,
  2. To carry out the ratification of the same,
  3. To cancel them or
  4. Opposition to their use in the following cases:
  5. When you are not the owner of the personal data you are requesting.
  6. When the personal data you requested is not in our databases.
  7. When the rights of a third party could be affected.

MEANS TO LIMIT THE USE OR DISCLOSURE OF PERSONAL DATA.


MAJA Sportswear, in order to guarantee the protection of the Personal Data of the Holders, undertakes to enter into legal acts, adopt privacy policies, Personal Data protection and information security enforceable within its organization, as well as to implement technological, physical and administrative security measures.

MAJA Sportswear stores personal information in limited-access databases located in controlled facilities with security mechanisms. MAJA Sportswear undertakes to ensure that the information provided by the Data Subject is considered and treated confidentially.

MAJA Sportswear provides alternative mechanisms for exercising ARCO Rights so that Data Subjects can limit the use and disclosure of their Personal Data. In this regard, Data Subjects are informed that, to avoid receiving advertising, they may register in the Public Registry to Avoid Advertising (REPEP) of the Federal Consumer Protection Agency (PROFECO), at the link https://repep.profeco.gob.mx/

MAJA Sportwear does not guarantee the security of personal data that you make public or that may be lost, altered, destroyed or misused by third parties other than your direct or indirect staff, or in the event of an act of God or force majeure.


Any MAJA Sportwear staff who have access to your personal data will maintain strict confidentiality regarding said data.


PERSONAL DATA STORAGE PERIOD.

In compliance with the quality principle, all Personal Data of the Data Subject will be safeguarded for the time necessary to fulfill the purposes for which it was collected. Subsequently, a blocking period will be applied prior to its deletion.


INFORMATION ON THE USE OF MECHANISMS IN REMOTE OR LOCAL MEANS OF ELECTRONIC, OPTICAL OR OTHER TECHNOLOGY COMMUNICATION, WHICH ALLOW THE COLLECTION OF PERSONAL DATA AUTOMATICALLY AND SIMULTANEOUSLY AT THE TIME THAT THE OWNER MAKES CONTACT WITH THEM (COOKIES / WEB BEACONS).
